On March 11, 2021, the Biden administration rescinded the 2019 public charge restrictions on green cards. Enrolling in a marketplace plan or getting help paying for coverage (in the form of subsidies) is not considered to be a public charge.
This means, that:
1) if you have eligible immigration status, you can apply for health insurance through the marketplace and accept any premium tax credits you're eligible for.
2) it won't affect your eligibility for a green card
According to Healthcare.gov:
- "Enrollment in a Marketplace plan (with or without premium tax credits) is not a public benefit under the public charge final rule.
- For children under age 21 and pregnant women, enrollment in Medicaid or the Children’s Health Insurance Program (CHIP) won’t be considered to be a public benefit under the public charge rule."
Additionally, receiving Medicaid while going through the immigration process is no longer considered in public charge determinations and will not disqualify you from obtaining a green card.
